Terms of Service

1. Introduction

These terms of service (the "Terms") govern your use of the File Finder (the "App") provided by Dumfounded Tech (the "Company"). By using the App, you agree to be bound by these Terms, as well as any other terms, policies, and guidelines that may be posted on the App from time to time, including without limitation our Privacy Policy.

2. Description of the App

The App is a Shopify app that allows users to organize and categorize their files. The App is intended to be used as a tool for managing and organizing personal or business-related files and documents.

3. User Accounts and Eligibility

In order to use the App, you must create an account and provide certain information about yourself as prompted by the registration process. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; and (c) your use of the App does not violate any applicable laws or regulations. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

4. Proprietary Rights

The App, and all intellectual property rights associated therewith, including without limitation patents, trademarks, copyrights, trade secrets, and proprietary technology, are the sole and exclusive property of the Company or its licensors. Except as explicitly provided in these Terms, you are not granted any rights or license to use any of the Company's intellectual property, and the App may not be used, copied, displayed, performed, distributed, or otherwise exploited except as specifically permitted by these Terms.

5. User Content

The App may allow you to upload, store, or otherwise make available content, including without limitation files and documents (collectively, "User Content"). You retain all rights in and to the User Content, and are solely responsible for the accuracy, quality, integrity, legality, reliability, and appropriateness of such User Content. You grant the Company a non-exclusive, perpetual, irrevocable, worldwide, transferable, sub-licensable, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, and otherwise exploit the User Content in connection with the App and the Company's business.

6. Restrictions on Use

You agree not to use the App for any illegal or unauthorized purpose. You must not, in the use of the App, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

7. Disclaimer of Warranties

THE APP AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY MAKES NO WARRANTY THAT THE APP OR ANY SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

8. Limitation of Liability

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, loss of use, loss of data, or loss of goodwill, arising out of or in connection with the use of the App, even if the Company has been advised of the possibility of such damages. In no event shall the Company's total liability to you for all damages, losses, and causes of action arising out of or relating to these Terms or your use of the App (whether in contract, tort, including without limitation negligence, or otherwise) exceed the amount paid by you, if any, for using the App.

The Company does not guarantee the accuracy, completeness, or reliability of the App, or that the App will be free from errors, inaccuracies, or other harmful components, and you acknowledge that your use of the App is at your own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and its and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including without limitation reasonable attorneys' fees, resulting from your use of the App, your violation of these Terms, or your violation of any rights of another.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is located, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts located in the jurisdiction in which the Company is located.
